DMCA Copyright Policy

1. Introduction

PathMatch LLC ("we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have implemented a policy that provides for the removal of infringing materials and the termination of users who are repeat infringers.

2. DMCA Takedown Procedure

If you believe that material available on hwbanana.com infringes your copyright, you may request removal of that material (or access to it) by submitting a written notification to our Copyright Agent (designated below). The notification must include the following information:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including URLs or other specific location information).
  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedure

If you believe that material you posted on the Service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. The counter-notification must include:

  1. Physical or Electronic Signature: Your physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Contact Information: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided notification of the alleged infringement.

If we receive a valid counter-notification, we may restore the removed content unless the original complainant files a court action against you within 10 business days of receiving a copy of your counter-notification.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. False Claims

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unsure whether material available online infringes your copyright, we suggest that you first contact an attorney.

Filing a false DMCA notice or counter-notification may result in liability for damages, including costs and attorney's fees. We reserve the right to pursue damages against any party that submits a false notification or counter-notification.

Please note that email is the preferred method of communication for DMCA notices. Include "DMCA Copyright Notice" in the subject line to ensure your notice is processed promptly.

7. Processing Time

We will respond to valid DMCA takedown notices promptly and in accordance with the DMCA. Generally:

  • We will acknowledge receipt of your notice within 48 hours
  • We will remove or disable access to the allegedly infringing material within 10 business days if the notice is valid
  • We will notify the user who posted the material and provide them with a copy of the takedown notice
  • We will provide the user with information about the counter-notification procedure

8. Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to this page. We encourage you to review this policy periodically to stay informed of any updates.
